Assignment: You may not assign, transfer, or delegate your rights or obligations under these Terms, whether by operation of law or otherwise, without the prior written consent of Ashrayas. Any attempted assignment in violation of this clause shall be null and void. Ashrayas may assign or transfer its rights and obligations under these Terms without restriction.
Severability:
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be limited or modified to the minimum extent necessary so that the remaining provisions of these Terms remain valid and enforceable.
Force Majeure: Ashrayas shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure arises from events beyond its reasonable control, including but not limited to natural disasters, acts of government or regulatory authorities, cyber-attacks or technological disruptions (“Force Majeure Event”).
THE PLATFORM IS PROVIDED TO YOU “AS IS” AND “AS AVAILABLE” AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, ASHRAYAS, ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES, PARTNERS, LICENSORS, SERVICE PROVIDERS, PRACTITIONERS, MENTORS, ADVISORS, AND CONTENT PROVIDERS, EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WARRANTIES ARISING FROM COURSE OF DEALING, PERFORMANCE, OR TRADE PRACTICE.
Without limiting the foregoing, Ashrayas makes no warranty, representation, or undertaking that:
The Platform, services, or products offered through it will meet your requirements;
The Platform will achieve any intended results or outcomes;
The Platform will be compatible with other software, applications, systems, or services;
The Platform will operate without interruption or errors;
Any errors, defects, or technical issues will be corrected. and
Further, Ashrayas makes no representation or warranty regarding:
The operation or availability of the Platform or any information, content, or materials available on it;
The uninterrupted or error-free functioning of the Platform;
The accuracy, reliability, or completeness of any information provided on the Platform;
The absence of viruses, malware, scripts, trojan horses, worms, timebombs, or other harmful components within the Platform, servers, or communications sent from Ashrayas.
Some jurisdictions do not allow exclusion of certain warranties or limitations on statutory consumer rights. In such cases, the exclusions and limitations stated above shall apply to the fullest extent permitted under applicable law.
